On the 26th March 2018 the Provincial Disciplinary Committee(PDC) of the ANC in the Eastern Cape convened to consider charges against comrades :
Ndyebo Skelenge – Respondent
Zibuthe Mnqwazi- Respondent
Luxolo Mandela – Respondent
Zakhele Mkiva – Respondent
All the Respondents were alleged to have contravened rules 25.17.6, 25.17.9, 25.17.16.2 , and 25.17.16.3 and 25.17.20 of the ANC Constitution .
The charges had been brought by the Provincial Executive Committee of the African National Congress in the Eastern Cape( Complainant) .
On the 8th April 2018 ,the PDC heard the case consisted of cdes ,Thokozile Sokhanyile( Chairperson),Simthembile Khulu,William Ngozi,Elias Makhanya and Cde Mabhengu .
On 8th April 2018 ,the PDC heard and ruled on procedural matters presented
on behalf of the Respondents .
The PDC reconvened on the 22nd April 2018 to continue with the hearing on the merits of the case .
The PDC ruled that :
All the Respondents have been found guilty of all charges on misconduct .
Sanction-
Ndyebo Skelenge –
The membership of the Respondent in the ANC is suspended for five years which is wholly suspended for one (1) year on condition that he complies with the following conditions –
a) The Respondent must never be charged for misconduct by the ANC again during the period of one (1) year from the 29th April 2018 .
b) The Respondent must resign with immediate effect as the Executive Mayor of the Mnquma Local Municipality not later than end of business on 2 May 2018 by delivery of a letter of resignation to that effect upon the Speaker of the Mnquma Local Municipality and the Municipal Manager of the said municipality on the 2nd May 2018 .
c)The Respondent must facilitate that a special council meeting is held by the Mnquma Local Municipality to elect a new Executive Mayor not later than end of business on 4th May 2018 .
d)If the Respondent fails to comply with the conditions set out in paragraphs 36 (a) and (b) the five year suspension of his membership shall take effect .
The Respondent is hereby advised that he has a right to appeal against both the findings on guilt as well as the sanction within 21 days from date hereof to the National Disciplinary Committee .
Zibuthe Mnqwazi –
Sanction:
a)The Respondent’s membership of the ANC is suspended with immediate effect for a period of five years .
b) The Respondent is hereby advised that he has a right to appeal against both the finding on guilt as well as the sanction within 21 days from date hereof to the National Disciplinary Committee .
Zakhele Mkiva –
Sanction:
The membership of the Respondent in the ANC is suspended for five years with immediate effect from the 29th April 2018 .
The Respondent is hereby advised that he has a right to appeal against both the finding on guilt as well as the sanction within 21 days from date hereof to the National Disciplinary Committee.
Luxolo Mngandela –
Sanction:
The membership of the Respondent in the ANC is suspended for five years which suspension is wholly suspended for a period of one(1) year on condition that the Respondent is not charged again for any act of misconduct in terms of the ANC constitution within the said period of one (1) year effective from the 29th April 2018 .
The Respondent is hereby advised that he has a right to appeal against both the finding on guilt as well as the sanction within 21 days from date hereof to the National Disciplinary Committee.
